The complaint charges in the first count that defendant, while driving his automobile on Clovis Avenue in Fresno, in a careless and negligent manner, caused his car ""to hit and run over"" said dog, and as a direct and proximate result thereof defendant ""caused the death . . . of the dog."" Damages in the sum of $3,000 were claimed.
