On the 4th day of December, 1964, the plaintiff Betty Wells was the guest in an automobile driven by Gail D. Bauer when a bus owned by the defendant Beloit City Bus Lines, Inc. (bus line) crashed into the rear end of the vehicle. Betty Wells brought this suit against the bus line and its insurer National Indemnity Company to recover damages for the personal injuries she sustained in the accident. The bus line impleaded the host driver Gail D. Bauer and her insurer Western Casualty & Surety Company for the purpose of contribution. The case was tried to a jury. Gail D. Bauer was found not negligent but the jury found the bus driver causally negligent and assessed the plaintiffs damages at $17,000 exclusive of medical expenses, the amount of which was stipulated by the parties. The court found Betty Wells was not contributorily negligent as a matter of law.
